AXA, ACE, AIG, Allianz, JLT, RSA, XL, Zurich, HSBC, Lockton, Marsh, Willis and Loss Adjusters Crawfords are all backing Airmic in their attempt to resolve large claims within 90 days by limiting the use of the reservation of rights clause which it is thought insurers are routinely invoking. The reservation of rights clause effectively puts the policyholder on notice that insurers are checking their position prior to confirming that their policy will respond to a claim. If a 90-day agreed time frame can be put in place from the time a claim is notification to the time that insurers may invoke the reservation of rights clause it is hoped that more claims can be resolved amicably without recourse to legal action.
