In 2021, the Civil Liability Bill increased the small claims limit for Road Traffic Act personal injury claims from £1,000 to £5,000. Traditionally, solicitors have recovered their costs from the opponent. However, many personal injury claims now fall into the small claims court. For these claims, solicitors will be looking to recover their legal fees from the legal expenses insurance providers. Where cover isn’t operational, fees will be deducted from injury claim settlements.
